Eligibility
Owners, employees, and independent contractors of WhatALooker.com ("Sponsor") and its affiliates, its advertising, promotion, and fulfillment agencies, and the immediate family members and persons living in the same household of such persons, are not eligible to participate in any contest.
Entrants who do not comply with any of these requirements or these Official Rules are not eligible to compete or win a prize. THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.
The total number of Entrants in each monthly contest is displayed on the home page of this Website. WhatALooker.com The home page display will update dynamically as the number of Entrants increases. Entry Deadline
The Sponsor offers one contest each month, in two categories: one category for photos of males and one category for photos of females. Each contest is open to new entries for one calendar month. The closing date and time of the current monthly contest is posted on the home page of this Website. WhatAlooker.com
Entry
All entries to each monthly contest must be submitted electronically via the entry form available only to Registered Users on their personal profile screen after login. The entry form must be completed in its entirety.
During the registration process, each Registered User is asked to choose his or her gender, which cannot be changed later. All entries submitted under that Registered User's username will be automatically placed in either the male or female contest category, based on the chosen gender.
Entrants must pay a One Dollar ($1) entry fee through this Website for each photo submitted. Entrants may submit as many photos as they wish; however, there can be only one winner per username. Additionally, unless an Entrant chooses otherwise at the time of entry or afterward, his or her entry will be automatically renewed for subsequent monthly contests, for an entry fee of One Dollar ($1) for each photo entered in the previous monthly contest and not removed from the database prior to the beginning of the next monthly contest. Entrants may remove photos by logging in as a Registered User and following the instructions on the personal profile page.
By submitting an entry form for any contest, Entrant agrees to abide by and be bound by these Official Rules and any decision Sponsor or its designees make regarding any matters relating to the contest. All decisions made by Sponsor or its designees shall be final and binding. Sponsor reserves the right to disqualify from the contest, and any future contest or other promotion conducted by Sponsor, and to prosecute to the fullest extent permitted by law, any Entrant who, in Sponsor's reasonable suspicion, tampers with any of Sponsor's websites, the entry process, or any contest, violates these Official Rules, or acts in an unsportsmanlike or disruptive manner. In the event of disqualification of the winner, Sponsor may replace the winner with the next runner-up at the sole discretion of Sponsor.
All entries become the property of Sponsor. By entering the contest, the winner agrees to assign all of his or her rights, title and interest in the entry (including but not limited to all copyrights, trademarks, design rights, moral rights and all other intellectual property rights) to Sponsor or its designee(s). Entries will not be returned once received by Sponsor. Each Entrant grants Sponsor the right to disseminate information regarding the entries as part of Sponsor's ongoing marketing and public relations efforts with or without naming the Entrant and without compensation, notice to or approval from the Entrant, unless prohibited by law. Each Entrant expressly consents to the disclosure of his or her name as a contest winner to members of the public who request such information. Each Entrant represents that he or she has the right to grant, and does grant, Sponsor in perpetuity a royalty-free, nonexclusive, worldwide license to use, display, reproduce, distribute, and otherwise exploit, in all media, technologies, and other formats now existing or later developed, throughout the universe, the Entrant's submission, designs, and original images for all purposes related to the contest and for ongoing marketing and public relations efforts by Sponsor, and each Entrant waives all moral rights. Entrant agrees to take any additional steps reasonably requested by Sponsor in order to transfer and/or perfect the rights granted or warranted to Sponsor in these Official Rules.
By entering the contest, Entrant consents to Sponsor's use of his or her name, photograph and/or likeness, address, voice, and statements made by or attributed to him or her, in perpetuity, in all media, technologies, and other formats now existing or later developed (including but not limited to print, broadcast, and Internet), for all business purposes, such as advertising and promotional activities, without additional compensation, notice, or approval, unless prohibited by law.
By entering the contest, Entrant warrants that he or she is the sole designer, creator, and owner of the entry, including all visual components, or has permission to use copyrighted components, and further warrants that the entry does not contain information considered by Entrant's place of business or any other third party to be confidential, and that the entry does not infringe the rights of any third parties. Entrant must have obtained all necessary releases from any persons or related to any subject matter appearing in each entry.
Sponsor may reject photos submitted for entry for any reason, in its sole discretion, including but not limited to violations of the Terms and Conditions of the Website or violations of these Official Rules.
Contest of Skill
Because this is a contest of skill, winning is dependent on the quality of entries received.
Judging Criteria
Contest winners are determined by ratings, on a 10-point scale, which visitors to the Website give to photos entered in each monthly contest. No fee or registration is required to rate a photo. Only one rating per Internet Protocol (IP) address will be permitted for each photo entered in each monthly contest.
The winner of each monthly contest category (male and female) will be the Entrant with the highest average rating as of the closing date and time posted on the home page of this Website. WhatALooker.com. There will be two winners, one for each category, each month.
Finality of Decisions
All decisions of Sponsor are final and binding in all matters relating to this contest.
Prizes
The winner of each category for each monthly contest will be awarded the cash prize displayed for that category on the home page of this Website, WhatALooker.com, fixed as of the closing date and time for the contest. The actual amount of the cash prize will vary based on the number of eligible entries received. The home page display will update dynamically as the amount of the cash prize increases and will become fixed when the contest closes for that month. In the event of a tie, Sponsor will determine in its sole discretion the winner and may, but is not required to, divide the cash prize evenly among multiple winners. The odds of winning depend on the number of eligible entries received. Once a winner is determined, the cash prize will be paid electronically, within five (5) business days, to Entrant's PayPal® card account (or other payment account) set forth in Entrant's registration information at the time of payment. Entrant is solely responsible for updating his or her registration information as needed on the Website. The winner may be disqualified in the event the cash prize cannot be paid because of inaccurate registration information or any other reason.
Notification of Winner
The winner will be notified by e-mail and/or regular mail and must sign and return any documents, if requested, within the time period stipulated in the documents. Failure to comply with this requirement may result in disqualification. Any notification returned as undeliverable may result in disqualification. In the event of a dispute about the identity of an individual, entries made online will be declared submitted by the Authorized Account Holder of the e-mail address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider or online service provider or other organization that is responsible for assigning e‑mail addresses for the domain name associated with the submitted e-mail address. The winner may be required to provide Sponsor with proof that the potential winner is the Authorized Account Holder of the e-mail address associated with the winner.
The username of each winner will be posted for a period of time on the Website, accessible by using the contest history link on the home page. Winners History. Individuals may request the name of winners by submitting a self-addressed, stamped envelope within 90 days of the entry deadline for the particular contest to Sponsor's mailing address as shown below.
Taxes
ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. Sponsor reserves the right to withhold any taxes as required by applicable law. All prizes will be awarded (other than prizes withheld for tax purposes as required by applicable law) and are not transferable. No substitutions (including for cash) are permitted, except Sponsor reserves the right to substitute prizes of equal or greater monetary value to the prizes if for any reason any prize cannot be awarded as contemplated in these Official Rules. The winner will be required to supply a Social Security number or other taxpayer identification number prior to the award of any prize.

SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR ENTRANT'S PARTICIPATION IN ANY CONTEST. SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM OR RELATES TO PARTICIPATION IN THE CONTEST, OR WINNING OR USE OF A PRIZE, INCLUDING BUT NOT LIMITED TO: (1) LATE, LOST, DELAYED, DAMAGED, MISDIRECTED, INCOMPLETE, OR UNINTELLIGIBLE ENTRIES; (2) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS, FAILURES, VIRUSES OR DIFFICULTIES OF ANY KIND; (3) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS; (4) THE UPLOADING OR DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH THIS CONTEST; AND (5) ANY OTHER CONDITION THAT MAY CAUSE THE CONTEST TO BE DISRUPTED OR CORRUPTED. SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND OR CANCEL ANY CONTEST OR ALTER THE RULES FOR ANY REASON, INCLUDING BUT NOT LIMITED TO ALTERATION OR CORRUPTION OF THE ADMINISTRATION OF THE CONTEST BY COMPUTER VIRUS, TECHNICAL PROBLEM, OR OTHER UNFORESEEABLE EVENT.
Release
BY ENTERING ANY CONTEST, EACH ENTRANT AND EACH OF HIS OR HER EMPLOYEES, CONSULTANTS, OFFICERS, DIRECTORS, AND AGENTS RELEASES AND AGREES TO HOLD HARMLESS SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, OWNERS, EMPLOYEES, AND AGENTS FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES, OR DAMAGES OF ANY KIND (INCLUDING BUT NOT LIMITED TO THOSE RELATED TO PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY, INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY, OR PRIVACY OR DEFAMATION) ARISING OUT OF OR IN CONNECTION WITH: (1) ENTERING THE CONTEST; (2) ACCEPTANCE OR USE OF ANY PRIZE; OR (3) ANY OTHER ACT OR OMISSION ARISING OUT OF OR RELATING TO THE CONTEST.
Governing Law
The monthly contests and the rights and obligations of Sponsor and Entrants will be governed by and controlled by the laws of the State of California, applicable to contracts made and performed therein without reference to the applicable conflicts of law principles. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the State of California, County of Los Angeles. The parties consent to the jurisdiction of the federal and state courts located in the State of California, County of Los Angeles, with respect to any action, dispute, or other matter pertaining to or arising out of any contest.
